With WelTel, your privacy is very important to us. This Privacy Policy is both an agreement hereby entered into by you and WelTel Incorporated (“WelTel”, “we”, “us”, “our”, or other similar terms), and also a policy that describes how our services handle and secure the information we collect through the WelTel Health Platform (the “Platform”, as defined in the End User License and Services Agreement).

Introduction

Outlined below are the terms and conditions for the use of WelTel Health, Integrated Virtual Care, and Patient Engagement Platform, applying to both healthcare/content providers and end-users. It governs their interaction with the online interfaces and properties controlled by WelTel Incorporated, including the website, online dashboard, and texting application. "Providers" refers to healthcare and informational content providers, while "Users" are those receiving services through the WelTel Health Platform. By accessing the site and using the services, you are bound by these Terms of Service, encompassing WelTel's Terms of Use and Privacy Policy, and agree to comply with all relevant laws and regulations. If you don't meet the eligibility criteria or disagree with these terms, you are prohibited from using WelTel's Site and Services.

How We Collect Information

All information you provide to the Platform is protected in accordance with relevant laws. The methods for collecting various types of information are detailed below:

User Accounts

In order to use the Platform and to receive Services you may be required to create a “User Account" through the Platform and be issued a username and password login credentials ("User ID"). We collect information such as your name, email address, phone number, date of birth and province or territory to create your User Account. If you are issued a User ID, you will be required to keep your User ID secure.  Services are also available for use by children at the discretion of the Provider. Parental / Legal Guardian approval is required if a User is under the age of 18 or otherwise unable to provide consent, requires use of the Platform to participate in a formal, controlled, research study. You may be asked to provide PI about your child/dependent in order to register them to a User Account.

Provision of Health Services and Support Services

Providers collect your personal information (PI) to offer you support and services, including but not limited to, your health card number, consultation request, and health history. They can access information in your profile and medical records, as well as create notes through the platform. WelTel, the platform, does not guarantee the skills of the independent Providers. You are responsible for choosing your Provider, and after sharing your PI, it is the Provider's responsibility to comply with professional regulations and privacy laws.

Usability Information

We collect usability information from your activity on the Platform for the purpose of operating and improving the Platform, including but not limited to the date and time of when you use the Platform, the pages you access and the features you use.

By utilizing the Platform, you are granting consent for WelTel to collect and use your Personal Information, Health Information, and Usability Information as explained below.

How We Use Information

Collection of Personal Information is limited where possible. We use your PI for the purposes for which it was collected, as well as other purposes for which you have given consent. In addition to those purposes set out above, this includes, but is not limited to, the following purposes:

How We Disclose Information

We will not disclose, share, sell or rent your PI with or to any third party, except with your written consent or as required or permitted by privacy laws. We may disclose your PI as we deem necessary, in our sole discretion, to comply with any applicable law, regulation, legal process or governmental request.  

In some instances, we may retain other companies and individuals (“Associate”) to perform functions on our behalf, including, but not limited to website developers, service, and technology providers. Third parties (“Affiliates”) may be provided with access to your PI to perform the functions for which they have been retained. Our agreements with third parties will not permit them to use your PI for any other purposes and commit them to comply with applicable data privacy standards.

How We Use Aggregated Information

We may use, and disclose (to a third party) aggregated and de-identified Health Information and Usability Information from the ​Platform​, such that it is not associated with any individual account that personally identifies you (“Aggregated Information”). We reserve the right to collect, use, disclose, distribute, and otherwise exploit any and all Aggregated Information to the extent that such data is not linked to any particular individual.

Third-Party Sites

We do not have authority over the privacy policies and actions of third-party websites. Our Platform may include links to other websites and pages offered by third parties. Any data you decide to share with a third party goes directly to them and is governed by their privacy policy. We neither assume responsibility for nor endorse the privacy policies or practices of other websites and third parties.

How We Use Aggregated Information

WelTel aims to avoid using unnecessary third-party plugins and apps, unless for security purposes or to offer certain features to User. The following are examples of third-party apps used on the site. Please, read these carefully:

Confidentiality and Security Safeguards

All PI collected on the Platform is securely and digitally stored on servers physically located in Canada or the nearest designated country depending on requirements for data residency. The Platform is secured through encryption technologies and only you and your Provider have access to your PI. PI created in connection with the provision of Health Services is managed by the Providers in accordance with applicable privacy legislation. The Platform is licensed by us to your Provider and is used by your Provider to communicate with you. WelTel has achieved SOC2 type 1 certification, an independent audit which verifies our internal controls and processes.

We employ industry-standard security measures, including encryption, to safeguard your data's confidentiality and integrity. These measures protect against unauthorized access, use, or disclosure of your personal information (PI) while it's in our control. However, it's important to acknowledge that despite our security protocols, there are inherent technology risks that could lead to the unauthorized access or disclosure of your PI when using the Platform.

Information a User submits to WelTel that relates to their account is password protected. No employee of WelTel nor any automated system will contact a User by email asking for a User’s login details, password or any other personal information related or unrelated to WelTel. If any message claiming or appearing to come from WelTel is sent to you asking for such information, please report it immediately to privacy@weltel.org.

Accessing and Updating Your Personal Information

You can add, edit, or delete optional information appearing in your User Account at any time in your account settings. You can edit, but not remove, certain information (like an email address). We will exert reasonable efforts to promptly rectify or eliminate such information, if it falls under our jurisdiction and arises from Platform-related activities. However, it's important to note that the removal of unwanted Personal Information and Health Information, or the correction of inaccurate data, might impact our ability to deliver accurate and timely Platform services. In connection with the provision of Health Services, you have  additional rights under applicable privacy laws. You may request access or correction to your health records, withdraw your consent or request limits on the collection, use or disclosure of your PI for health care purposes by contacting your Provider.
 
If you feel the data WelTel has is inaccurate or requires updating, please send us an email to privacy@weltelhealth.com and we will update your records within one month of receiving the email.

Governing Law

All matters relating to your access or use of the Platform shall be governed by provincial and federal laws of Canada, applicable therein, without regard to principles of conflicts of law. You agree and hereby submit to the exclusive jurisdiction of the Canadian courts with respect to all matters relating to your access and use of the Platforms, as well as any dispute that may arise therefrom.

Changes to this Privacy Policy

At WelTel, we believe in continuous improvement, and we may add features and Services to our Platform. These changes may alter the practices of WelTel from time to time. We reserve the right to change this Privacy Policy at any time and such modifications shall be effective immediately, as of the date indicated at the top of this policy. If we decide to change our privacy policy, we will post those changes to this privacy statement, send you an email with a link to the updated policy and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
